1. INTRODUCTION & ACCEPTANCE OF TERMS

These Terms and Conditions ("Terms") govern the rental of vehicles from AVEUZ Car Rental ("Company", "We", "Us", "Our"). By accessing our website, mobile application, or booking a vehicle, you ("Renter", "You", "Your") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

These Terms apply to all types of vehicle rentals offered by AVEUZ, including but not limited to: self-drive rentals, long-term rentals, monthly subscriptions, and chauffeur services. The rental agreement shall be between you and AVEUZ Car Rental, with all transaction terms binding upon both parties.

2. ELIGIBILITY & RENTAL REQUIREMENTS

Age Requirements: You must be at least 21 years old with a valid driver's license (minimum 2 years driving experience). For drivers aged 21–25, an additional charge of PHP 500–1,000 per day may apply.

Valid Documentation: You must present a valid government-issued ID (Passport, Driver's License, or National ID), a valid driver's license, and a vehicle registration document (OR/CR). International renters must provide an International Driving Permit (IDP) alongside their home country license.

Proof of Payment: Valid credit/debit card or approved payment method must be provided. Card must be in the renter's name for verification purposes.

Insurance Eligibility: If insurance coverage is declined, you assume full liability for any damages. OFWs and balikbayan visitors are welcome; additional documentation may be required.

Prohibited Use: You must be of sound mind and may not rent if under the influence of alcohol, drugs, or controlled substances. AVEUZ reserves the right to refuse service to any person deemed unfit to operate a vehicle.

3. RENTAL TYPES & SERVICES

3.1 Self-Drive Rental

You assume full operational control of the vehicle. Available for short-term (hourly, daily) and long-term (weekly, monthly) rentals. All standard driving laws and safety regulations must be adhered to.

3.2 Long-Term Rental

Available for monthly or annual subscriptions. Monthly rates apply for rentals exceeding 30 days. Discounts may be negotiated. Early return results in no refund of unused days. Extended rentals beyond the agreed period will be charged at daily rates plus applicable penalties.

3.3 Chauffeur Service

A licensed driver is provided with the vehicle. Special rates apply; minimum booking period may be required. Chauffeur service hours and overtime rates will be detailed in a separate service agreement.

4. BOOKING & RESERVATION

Reservations can be made online via our website, mobile application, or by contacting our office directly. A booking confirmation with reference number will be sent via email or SMS. AVEUZ reserves the right to substitute with a vehicle of equivalent or higher class if necessary.

5. RENTAL FEES & PAYMENT TERMS

Rental Rate: Daily, weekly, monthly, and hourly rates are confirmed at booking. GST (12%) is included in quoted rates.

Delivery & Pickup: Standard delivery and pickup within Metro Manila (NCR) is free. Delivery/pickup to provinces may incur an additional charge of PHP 2,000–5,000 depending on distance. Airport pickup has a premium of PHP 500.

Payment Methods: Accepted: Credit/Debit Cards, Bank Transfers, GCash, PayMaya, and Cash (for deposit). A security deposit (PHP 5,000–20,000 depending on vehicle) is required and will be returned upon vehicle return if no damages are reported.

Non-Refundable Fees: All rental fees, insurance premiums, and delivery charges are non-refundable except in cases of cancellation within 48 hours of booking or force majeure circumstances.

6. CANCELLATION & REFUND POLICY

Cancellations made more than 48 hours before the rental start date will receive a 75% refund. Cancellations within 48 hours forfeit the entire rental fee. No refund is issued for cancellations within 24 hours or on the rental date.

The security deposit will be returned within 5 business days of vehicle return, provided no damage claims are filed.

7. VEHICLE CONDITION & INSPECTION

You must inspect the vehicle at pickup and note any pre-existing damage on the Vehicle Checklist Report provided. This report is mandatory and must be signed by both parties. Damages not documented will be assumed to have occurred during your rental.

Damage Classification: (A) Minor Scratch/Dent (up to PHP 5,000); (B) Major Damage (PHP 5,001–50,000); (C) Collision Damage (exceeding PHP 50,000); (D) Theft/Total Loss.

8. DAMAGE & LIABILITY

You are responsible for all damage to the vehicle during the rental period, including accidents, collisions, theft, vandalism, and damage caused by negligence or misuse.

If the vehicle is out of service due to damage, a loss-of-income charge of PHP 2,000 per day will apply until repairs are completed (maximum 30 days), unless the renter has purchased our comprehensive insurance.

9. INSURANCE COVERAGE

Comprehensive insurance is available and recommended. If declined, you assume 100% liability for all damages. Coverage includes 50% of damage repair costs to the rental vehicle, 100% third-party liability, and medical/accident benefits.

10. FUEL & TOLL POLICY

The vehicle will be delivered with a full tank of fuel. You must return the vehicle with a full tank. All toll charges incurred during the rental period are the renter's responsibility.

11. VEHICLE USE & RESTRICTIONS

Prohibited activities include: off-road driving, racing, use for driving lessons, unlawful purposes, towing commercial cargo, smoking/vaping inside the vehicle, use for ride-sharing/taxi services (Grab, Uber, etc.) without authorization, and use with an undisclosed additional driver.

12. RENTAL PERIOD & LATE RETURNS

A grace period of 1 hour is provided for return without penalty. Return after 1 hour but within 5 hours incurs an overtime charge at 200% of the daily rate. Beyond 5 hours, an additional day's rental fee applies.

Late Return Charges: 5-seater vehicles: PHP 200/hour or PHP 2,000/additional day; 7-seater vehicles: PHP 250/hour or PHP 2,500/additional day. A late return administrative charge of PHP 500 also applies.

13. VEHICLE TRACKING & MONITORING

All AVEUZ vehicles are equipped with GPS tracking. AVEUZ may monitor vehicle location and contact you if there are concerns. If the rental period is significantly exceeded or the vehicle is taken to an unauthorized location, AVEUZ reserves the right to repossess the vehicle without prior notice.

14. TRAFFIC VIOLATIONS & ACCIDENTS

You are responsible for all traffic violations incurred during the rental period. In case of any accident: (1) Immediately stop and ensure everyone's safety; (2) Contact emergency services if there are injuries; (3) Notify AVEUZ within 30 minutes; (4) Obtain a police incident report; (5) Take photos of damage, scene, and other vehicles involved.

15. DRIVER REQUIREMENTS & CONDUCT

Only holders of a valid driver's license may operate the vehicle. You agree to follow all Philippine traffic laws, posted speed limits, and safe driving practices. Any additional drivers must be declared at booking (PHP 300/driver/day). Undisclosed drivers invalidate insurance coverage.

16. PRIVACY & DATA PROTECTION

AVEUZ collects personal information to process your rental and comply with legal obligations. Your data is used for booking confirmation, payment processing, customer service, and legal purposes. GPS tracking data is used for vehicle security and recovery. We do not sell your data to marketers.

17. TERMS OF SERVICE & VEHICLE ACCEPTANCE

By accepting delivery of the vehicle and signing the rental agreement, you acknowledge that you have read, understood, and agreed to all these Terms and Conditions.

18. DISPUTE RESOLUTION & GOVERNING LAW

These Terms and all rental agreements are governed by the laws of the Republic of the Philippines. Both parties consent to the exclusive jurisdiction of the Regional Trial Courts located in Metro Manila, specifically Quezon City, for any disputes.

19. LIABILITY LIMITATIONS

AVEUZ's total liability for direct damages shall not exceed the total rental fees paid for the subject rental. AVEUZ is not liable for indirect, incidental, consequential, punitive, or special damages.

1. INTRODUCTION

AVEUZ Car Rental ("Company", "We", "Us", "Our") is committed to protecting your privacy and ensuring you have a positive experience during vehicle rentals. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you interact with our services.

2. INFORMATION WE COLLECT

2.1 Information You Provide Directly

Booking & Rental Information: Name, email address, phone number, date of birth, address, driver's license number, vehicle registration document details, emergency contact information, and preferred pickup/return locations.

Payment Information: Credit/debit card details (partially), billing address, transaction history. Full card numbers are never stored by AVEUZ; payment processing is handled by PCI-DSS compliant third-party processors.

Communication Data: Messages, emails, phone calls, and inquiries submitted through our website, mobile app, or customer support channels.

2.2 Information Collected Automatically

Website & App Usage Data: Pages visited, browser type, IP address, device identifiers, and referral source. Collected via web analytics tools (Google Analytics) and server logs.

GPS Vehicle Tracking: Real-time location data, route history, speed, acceleration/braking patterns, fuel consumption, and geofence notifications. This data is transmitted continuously during the rental period.

2.3 Information from Third Parties

Payment processors, insurance companies, government agencies (LTO driver license verification), and law enforcement when legally required.

3. HOW WE USE YOUR INFORMATION

Rental Processing, payment collection, vehicle security and GPS tracking, insurance claims management, customer communication, legal compliance, driver behavior assessment for safety and maintenance, and fraud prevention.

4. HOW WE SHARE YOUR INFORMATION

We share information with: PCI-DSS compliant payment processors, insurance companies (for claims), GPS tracking service providers, email marketing platforms, analytics services (Google Analytics), law enforcement when legally required, and service providers (maintenance facilities, towing services).

We do not sell your personal data to marketers or third parties for advertising purposes.

5. DATA SECURITY

We implement industry-standard security measures including SSL/TLS encryption, firewalls, access controls, and regular security audits. Payment processing is conducted through PCI-DSS Level 1 certified gateways. In the event of a data breach, we will notify affected individuals within 72 hours in accordance with the Philippine Data Privacy Act (RA 10173).

6. COOKIES & TRACKING TECHNOLOGIES

We use session cookies, persistent cookies, and analytics tools to improve user experience, remember preferences, and analyze website traffic. You may customize cookie preferences or disable non-essential cookies through your browser settings.

7. GPS VEHICLE TRACKING

All AVEUZ rental vehicles are equipped with GPS tracking devices that transmit real-time location data during the rental period. Data collected includes location coordinates, speed, route history, engine status, and driver behavior metrics. By accepting the rental vehicle, you consent to continuous GPS tracking. Disabling or tampering with the GPS device is grounds for immediate rental termination.

8. DATA RETENTION

Rental records are retained for 5 years for legal and regulatory compliance. GPS tracking data is retained for 12 months. Payment records are retained for 7 years per tax requirements. You may request deletion of your personal data after the retention periods, subject to legal obligations.

9. YOUR PRIVACY RIGHTS

You have the right to: access your personal information, request correction of inaccurate data, request deletion of your data (subject to legal retention requirements), object to specific data uses, receive a copy of your data in a portable format, and withdraw consent for marketing communications at any time.

For complaints regarding privacy violations, you may file a complaint with the National Privacy Commission (NPC) of the Philippines at www.privacy.gov.ph.

10. MARKETING & PROMOTIONAL COMMUNICATIONS

You may opt-out of promotional emails and SMS messages at any time by clicking "Unsubscribe" or changing your notification preferences. Transactional communications (booking confirmations, payment receipts) will always be sent regardless of marketing preferences.

11. CHILDREN'S PRIVACY

AVEUZ services are not intended for children under 18 years of age. We do not knowingly collect personal information from children.

12. COMPLIANCE WITH PHILIPPINE DATA PRIVACY ACT

AVEUZ complies with the Data Privacy Act of 2012 (Republic Act No. 10173). AVEUZ has appointed a Data Protection Officer to oversee data protection practices. For complaints, you may contact the National Privacy Commission (NPC) at www.privacy.gov.ph.

13. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically. For significant changes, we will notify you via email or prominent website notice at least 15 days before the changes take effect. Continued use of AVEUZ services after policy updates constitutes acceptance of the revised Privacy Policy.
